Technical strength is a measure of how innovative, non-obvious, practically useful and commercially valuable an invention is. Which simply also means that technical strength refers to the quality and merit of the patented invention. Technical strength is the foundation or base of Patent monetization. This is primarily because it directly affects the patent’s commercial value and the entire monetization strategy is built on it. Before a patent is licensed, sold or enforced, companies look at whether its technology offers real progress and value and can stand up to legal and technical scrutiny. There are 3 factors you should consider:

  1. Is this invention novel? : Novelty refers to an invention that must be genuinely new and should not be disclosed to the public anywhere in the world before the patent application is filed. Additionally, if the same invention has already been described and patented earlier, perhaps even in a research paper, publication or any other publicly available source, it is unlikely to satisfy the novelty requirement.   2. Is it an inventive step? : Inventive step is also called non-obviousness. The question you need to ask is would this invention be too obvious for a person having ordinary skill in a relevant field? For instance, plainly making a minor or predictable modification to an existing product is usually not enough. Your invention must display an evident technical advancement that is non obvious and provide an upgraded solution to an existing problem. The greater the inventive step, the stronger the patent's technical contribution is likely to be.
  3. Can it be applied in the real world? : A patented invention that has practical usefulness, is capable of being made or used in an industry and solves a real problem, is more likely to attract businesses interested in manufacturing, licensing or selling it. A patented invention that cannot be used practically is far less likely to generate commercial interest. Businesses are more likely to be interested in manufacturing, licensing, or selling a patentable idea if it solves a real problem, has practical utility, and can be produced or used in an industry. A patentable invention is much less likely to attract economic attention if it cannot be applied effectively.

Assessing novelty, inventive step, and real-world applicability provides a clear picture of the technical contribution made by an invention. These factors decide how strong a patent is and will withstand legal scrutiny, whilst also influencing its commercial value and attractiveness.

Technical mapping to industry products

It is important to evaluate whether your patented invention has relevance in the market. The question here is, who is actually using technology that is similar to yours? Because if it has no market relevance and nobody is using it then there may be no one willing to pay for it.

Technical mapping is done by comparing your patented invention with existing industry products and technologies. This helps in identifying companies that may be using similar technology and could potentially become licensees, partners or even infringers. But primarily, it serves as a bridge between the technical strength of a patent and its commercial opportunities.

Evidence of Use : One of the important ingredients of technical mapping is recognizing Evidence of Use (EoU). EoU. Evidence here refers to proof that a company is practicing or carrying put your patented invention. Without any evidence, you simply cannot accuse them of infringement. The information showing whether a product or process uses features of your patented invention can be through any publicly available sources like product details, user manuals, public illustration etc. This helps in identifying infringers and possible commercial opportunities.

Market Overlap : If your patented invention is extremely similar to another existing product, service or process, it may be an advantage for you under the concept of market overlap. A patent that relates to technology that is already used widely in an industry is generally more valuable. Why? Because it will have more practical demand. Thus, the more prominent a market overlap is, the more likely it is to entice the market and increase your patent’s monetization. When the claims are weak, competitors can usually find a way around infringement or even dispute the patent’s validity. So, checking where the claim weak points are is really a key step for judging how strong the patent is, and what it could mean for licensing, enforcement, or some other monetization strategy. By checking prior art threats, design-around options, and claim weaknesses, businesses can see the risks before trying to monetize a patent. Fixing these issues early can make the patent stronger, reduce legal problems, and help choose a better monetization strategy.

Leveraging external technical analysis

Analysing a patent’s technical strength involves more than just legal knowledge. Many patents with highly specialized technology demand external expertise such as engineers, scientists or patent analysts. By assessing, these experts help answer questions like: Is the invention genuinely new, inventive and practically useful? Is it different from existing products and earlier technologies? Is another company's product actually using this invention? Is there any kind of infringement? They may review technical documents, product details, manuals, and other public sources to find Evidence of Use. In this manner, legal knowledge combined with technical expertise can help define the true value of a patent. External technical analysis reduces uncertainty, supporting informed commercial decisions, and improves the chances of successful patent monetization.

Integrating findings into monetization models - licensing, sales, assertion, and partnerships

After determining the technical strength of a patent, its connection to industry products, potential risks, and technical assessment, the next step in patent research is to determine the best method for patent monetization. The results of the studies conducted can be used by companies to identify the value of a patent and develop a strategy for its profitable use and potential risks. Based on the analysis results, a company can choose a particular type of patenting for commercialization, such as licensing, selling, asserting, or patent cross-licensing.

  • Licensing is often the best option for patent monetization. If the evaluation is positive, meaning that the patent has got demand on the market, the owner can license it to other companies and earn money by giving them rights for the invention’s implementation. The higher the demand for the patent, the more potential licensees are willing to pay for it.
  • In some cases, the most optimal method for patent monetization might be its sale. The option is attractive for a patent holder who owns a patent with significant technical and commercial value. Such a patent can be sold via a single transaction to another company, which, in turn, will be able to use the technology described in the patent exclusively. Thus, the patent owner can capitalize on the patent by receiving a lump-sum payment and transferring the ownership of the patent to another company.
  • If technical analysis and Evidence of Use confirm that another company is using your patent without permission, it may be appropriate to assert your rights by sending a cease-and-desist letter or a demand for arbitration or litigation. A thoroughly researched and carefully prepared patent can help you maximize your negotiating position and the potential for success in any dispute.
  • A patent can also be sold by striking a partnership deal. In this case, the patent owner does not sell or license it on an independent basis, but collaborates with one other company to develop, produce, and market the unique product. Both sides can profit from such agreements as they share the costs and risks involved in bringing the innovation on the market.

Patent monetization is best when based on a comprehensive technical analysis. By analyzing the strengths, exploring the opportunities, evaluating the threats, and consulting experts, companies identify which monetization methods will be the most profitable for their patents. In turn, this allows the owners to profit from their intellectual property while protecting it from possible infringement.

Patents provide a guarantee of obtaining significant commercial benefits from an invention if they are owned exclusively by a company. However, for their practical implementation, it is necessary to determine their commercialization potential, the accompanying risks, and the strengths of the patent, and the most optimal way of work and the technique for its implementation.
