PATENT FILING IN IRAN

Iran joined Paris Convention in 1959 and is a member of WIPO since 2001. IRIPO is the intellectual property office for Iran.

With the vision of globalization of patent filings, IRIPO has modified its intellectual property laws for better coordination and connectivity with other nations. IRIPO strictly restricts the patentability of pharmaceutical formulas and compounds; however, patent applications may be filed for processes related to the manufacture of pharmaceuticals.

A patent may get canceled if it has not been worked during the five-year period following its date of grant. IRIPO requires patent applications to be translated into Persian.

Filing to Grant Procedure

STEP 1 : FILING

A patent can be filed in Iran as any of the following formats:

  • Paris Convention based national entry.

  • PCT National Phase based national entry.

STEP 2 : EXAMINATION
  • Examination starts automatically once the examination on formal requirements is completed.

STEP 3 : PROSECUTION
  • Response to Examination Report has to be submitted within 2 months from the date of First Examination Report (FER).

STEP 4 : GRANT
  • Annual fees are payable two months prior to the first anniversary of entry into the national phase and each subsequent year thereafter. Protection of the Patent is for 20 years from the International Filing Date.

STEP 5 : PUBLICATION
  • Publication of Iranian patents is done upon grant.
